    Terms of Service

    Heritage Melbourne is a property advertising and discovery platform operated by Heritage Melbourne Pty Ltd (ABN 50 699 399 043). These terms apply when you browse the site, create an account or contact an agent through it.

    By using the site, you agree to these terms. If you do not agree, do not use the site. Nothing in these terms excludes a right or remedy that cannot lawfully be excluded. The site is intended for use in Australia by people aged 18 and over.

    1. What Heritage Melbourne does

    We publish property listings supplied by licensed estate agents, publish our own building and precinct material, and pass enquiries and appraisal requests to agents. We may charge agents for advertising placement and presentation. Buyers and visitors do not pay us to use the site, and we do not receive a commission or success fee from a property sale.

    We are not an estate agency, do not act for a buyer or vendor, do not negotiate a sale, do not hold trust money and are not a party to any property transaction. Nothing on the site is legal, financial, property, tax or investment advice or a valuation.

    An engaged agent's commercial relationship with us is governed by their private Engagement Letter, the published Listing Terms and the published Listing Content Rules. The Engagement Letter is not a public document.

    2. Listings and property information

    Listing descriptions, photographs, floor plans, prices, inspection times, features and documents are supplied by the listing agent or agency. We do not independently inspect properties or verify that this material is accurate, complete or current.

    Agents remain responsible for their own advertising and legal obligations, including any Statement of Information and any price representation. A document appearing on the site does not mean we have verified its contents. If you believe something published here is wrong, tell us at info@heritagemelbourne.com and we will look into it.

    Before relying on anything, confirm it with the agent and obtain any independent advice and inspections you need. The contract of sale and vendor statement, not this site, govern a property purchase.

    3. Placement and ordering

    Headline is our paid advertising tier, although we may provide Headline treatment without charge. Headline listings receive stronger placement and a fuller presentation than Classic listings. The Featured view is therefore promotional rather than a neutral ranking. Other available sorts apply the criterion shown on the page.

    We do not claim to show every eligible apartment for sale. We show properties we accept and that agents choose to list with us.

    4. Enquiries and agents

    When you send a property enquiry, inspection registration or appraisal request, we send the details you provide to the relevant agent so they can respond. The agent then handles their copy of your information under their own legal obligations. Our Privacy Policy and Collection Notice explain this further.

    Agents and agencies are independent from us. We do not control whether an agent responds, what they say, or any later dealings between you and them.

    5. Accounts and communications

    You must provide accurate account information, keep your sign-in details secure and tell us promptly if you believe your account has been misused. You are responsible for activity carried out through your account unless it resulted from our failure to take reasonable care.

    We send service messages needed to operate an account. We send newsletters and alerts only where you have subscribed or requested them. Marketing messages identify us and include a way to unsubscribe. You can also ask us to stop at info@heritagemelbourne.com.

    You may stop using the site at any time. To request account closure, email us. Some records may be retained where reasonably needed or required by law, as described in the Privacy Policy.

    6. Acceptable use

    You must not:

    • use the site unlawfully or submit false, misleading, fraudulent or unsolicited material;
    • impersonate another person or misuse another person's personal information;
    • try to access an account, system, document or data you are not authorised to access;
    • interfere with the site's operation, security or availability, or introduce malicious code;
    • use enquiry forms for spam, marketing or bulk messages; or
    • use automated means to overload, disrupt or circumvent controls on the site.

    If you provide another person's details, you must have authority to do so and must make them aware of the relevant privacy information.

    7. Content and automated use

    The site, our editorial material, design and branding are owned by us or used under licence. Agent listing material remains owned by its respective rights holder. You may view and share links to public pages for personal, non-commercial use.

    Except where the law permits it, you must not reproduce, republish, sell or commercially exploit site content without the rights holder's permission. You must not scrape the site or use its content to build, train, evaluate or supply a machine-learning model or dataset without our written permission. Search engines may index public pages in accordance with our robots.txt file, but robots.txt does not grant a licence to reuse content.

    8. Availability, changes and suspension

    We may change, suspend or withdraw features and cannot promise uninterrupted or error-free access. We may suspend or close an account where we reasonably believe these terms have been breached, the account creates a security or legal risk, or the law requires us to act.

    Where reasonably practicable, we will tell you about an account suspension or closure and give you an opportunity to contact us. We may act immediately where needed to protect people, data, the platform or comply with law.

    9. Liability

    Our services come with rights and guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those rights, or any liability that cannot lawfully be limited.

    Subject to those rights, we are not responsible for agent-supplied material, an agent's conduct, a property's condition or legal status, a decision made without independently checking relevant information, third-party services or websites we link to, or events outside our reasonable control.

    To the extent the law permits, we are not liable for indirect or consequential loss, and our liability is reduced to the extent your act or omission contributed to the loss.

    10. Changes to these terms

    We may update these terms prospectively. The current version and effective date appear on this page. Where the law requires notice or renewed agreement, we will provide it. An update does not change rights or liabilities that arose before it took effect, and if you do not accept an update you may stop using the site and close your account.

    11. General

    These terms are governed by the law of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. If a provision is unenforceable, it is severed to the minimum extent necessary and the remaining provisions continue. A delay in enforcing a right is not a waiver of it.
